How important is a Jury?

Many people don't realize why the right to a jury trial is so important in personal injury cases. Many people don't realize how important jurors are to our justice system.

Going to a jury in personal injury cases is often the last resort for many plaintiffs. It's not something they want to do. It's not something their lawyer wants to do. Many times, a jury trial happens because the victims simply have no other choice — aside from giving up their case.

It's easier without a Jury.

As a rule, it's a lot easier and a lot less expensive and time consuming to settle a personal injury or wrongful death or medical malpractice case before trial, than it is to bring it to a jury. Settling a case BEFORE it gets to a jury trial means a quicker award for victims and much less work for their attorneys.

So, if settlement is easier, quicker and less costly, why do we ever choose to bring a case to jury? The answer is, only a jury can help us.

The defendants in many personal injury and medical malpractice are often rich and powerful. They retain excellent lawyers who represent them very well.

Far too often, these defendants are confident enough to resist the obligation they owe to the injured, the maimed, the disabled, and the families of the deceased. Sometimes they can afford to be intransigent, refuse to offer reasonable compensation, and simply wait out victims who look like they might just give up.

When defendants in these cases make it this difficult for victims to get compensated for their loss, we have no choice.

We must go to the jury. They are our last hope.
